By accessing or using the Hamilton Exteriors website (hamilton-exteriors.com) or engaging our services, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, please do not use our website or services. We recommend reading these terms carefully before submitting any information or entering into any service agreement with us.

About Our Services

Hamilton Exteriors, Inc. is a licensed, bonded, and insured contractor based in Castro Valley, California. We provide residential and commercial exterior improvement services throughout the San Francisco Bay Area, including:

  • Roofing installation, repair, and replacement
  • Siding installation and replacement
  • Window installation and replacement
  • Waterproofing services
  • Accessory Dwelling Units (ADUs)
  • Home additions

Estimates and Pricing

Estimates provided through our website, phone consultations, or in-person inspections are approximations based on the information available at the time. All estimates are subject to change based on actual site conditions, material availability, and scope of work. An estimate is not a binding contract.

Pricing becomes binding only when both you and Hamilton Exteriors have signed a written service contract. The contract will specify the agreed-upon scope of work, materials, timeline, and total cost. Any changes to the scope of work after the contract is signed may result in adjusted pricing, which will be documented in a written change order.

Warranty Terms

Hamilton Exteriors stands behind the quality of our work. Our warranty coverage includes:

  • Labor warranty: We provide a 35-year labor warranty on qualifying installations, covering defects in workmanship. This warranty is transferable to subsequent property owners.
  • Manufacturer warranties: All materials we install carry the manufacturer's warranty, which varies by product and brand. We will provide you with manufacturer warranty documentation upon project completion.
  • Warranty claims: To make a warranty claim, contact us at (650) 977-3351 or support@hamilton-exteriors.com. We will schedule an inspection within a reasonable timeframe and, if the issue is covered, perform the necessary repairs at no additional cost.

Warranties do not cover damage caused by natural disasters, accidents, neglect, unauthorized modifications, or normal wear and tear.

Payment Terms

Payment schedules are outlined in your signed service contract. Typically, projects require a deposit upon contract signing, with remaining payments tied to project milestones or completion. We accept checks, credit cards, and financing through approved lenders.

Late payments may be subject to interest as permitted by California law. If payment is not received within the agreed-upon timeframe, Hamilton Exteriors reserves the right to pause work until the account is brought current.

Limitation of Liability

Hamilton Exteriors' total liability for any claim arising out of our services shall not exceed the total amount paid by you under the applicable service contract. We are not liable for indirect, incidental, special, or consequential damages, including lost profits, property damage not directly caused by our work, or delays caused by factors beyond our reasonable control (such as weather, material shortages, or permitting delays).

Nothing in these terms limits liability that cannot be excluded or limited under applicable California law.

Dispute Resolution

These Terms of Service are governed by the laws of the State of California. If a dispute arises between you and Hamilton Exteriors, we encourage you to contact us directly at (650) 977-3351 or support@hamilton-exteriors.com so we can try to resolve the matter informally.

If informal resolution is not possible, both parties agree to attempt mediation before pursuing litigation. Any legal action shall be filed in the courts of Alameda County, California. Each party shall bear its own attorneys' fees unless otherwise required by law.

Use of Our Website

You agree to use our website only for lawful purposes. You may not attempt to gain unauthorized access to any part of the website, interfere with its operation, or use automated tools to scrape or collect data without our written permission. Content on this website, including text, images, and design, is the property of Hamilton Exteriors and may not be reproduced without our consent.

Changes to These Terms

We may update these Terms of Service from time to time. When we make changes, we will update the "Last updated" date at the top of this page. Your continued use of our website or services after any changes are posted constitutes your acceptance of the revised terms. We encourage you to review this page periodically.
